AFFIDAVIT OF GERALDINE FOOI-FONG ROBERTSON - Defamation
I, Geraldine Fooi-Fong Robertson of 17-23 Buccan Road Buccan, Qld. 4207 states on oath
1. After my dogs were seized by RSPCA on the 9th January 2009 the TV News and the newspapers were full of material about my dogs and me. The RSPCA statements to the media initiated a barrage of abuse of me. What was said in the defamation was based on RSPCA malicious unfounded statements released by RSPCA to all medias some if it is still published by RSPCA websites and forums Petrescue at date of writing and was not proven in any Court and has now been shown by RSPCA perjury in the Brisbane Magistrates Court Appeal Hearing M6213/08 lodged by the Applicant to me lies.
2. It is my submission that RSPCA acted with improper motive when they released this material to the media. RSPCA campaigned for funds to “save the poor malnourished poodles” and was designed to make me surrender my dogs to them.
3. I became aware that I had become a media event shortly after the seizure when I was alerted to the massive defamation by RSPCA from breeders of poodles overseas. I aw my dogs and myself on TV news. I saw film of my front entrance and my business sign, of video that could only have been taken from inside my property and inside my house.
4. RSPCA released and saturated all the newspapers, television and radio stations with continuous defaming lies, fabricated videos and release of the Applicant’s personal details showing the full location and address of the Applicant’s premises incited the public to continuous telephone abuse which lasted for many weeks, send poison mail and arrive at my premises to assault and abuse me continuously from 13 January 2008.
5. Malicious and fictitious comments quoting RSPCA Veterinarians, Inspectors, Managers and staff was and still is reported and posted by the medias although the Court Exhibits provided by RSPCA at the Magistrate Court Appeal Hearing M6213/08 shows that RSPCA statements and claims were fictitious.
6. Material published on the Internet was there for public viewing for over 13 months after it had been put there. The defamation has been continuous for more than 13 months. The following attachments, pages 1 to 268, is only a small sample of the defamation posted on the internet.
7. I first started collecting the bulk of the material off the Internet in September, October 2008. I am aware that there was significantly more material published about me and that this material was also featured on TV News in New Zealand, the USA, Asia and other countries. Countries I had been selling my World Famous Neiger Poodles to. If all the material published about me had been collected I estimate it would be three times greater that it is presented to the Court.
8. Courier Mail Newspaper article dated 28th March 2008. Michael Pecic, who administers an Act of Parliament – the Animal Care and Protection Act 2001, with his photo making media statements in direct breach of RSPCA’s agreement with Department of Primary Industries and Fisheries. The matter was being Appealed and the statements made by RSPCA were not proven. The article invites hatred of me, the Applicant. (page 1). 9. Courier Mail Newspaper article dated 28th March 2008. Michael Pecic blaming me, the Applicant for RSPCA’s problems and going public to the media which was untrue. Exhibit GR2 to this affidavit is this article.
10. Courier Mail 13/1/2008 – I, Geraldine Robertson was pronounced guilty of animal cruelty in the media and the matters have not even begun their legal process “horrific cases of neglect and animal cruelty are stretching RSPCA resources” …. “RSPCA inspectors and Police raided Waterford Boarding Kennels and Cattery ….” “Geraldine Fooi Fong Robertson ….” Page 3. 11. Jimboomba Times – poodle puppies rescued 16/1/08. “The dogs were allegedly found standing in inches of urine and faeces at Waterford – Tamborine Road …. Michael Pecic said “infected wounds and urine burns” Page 4. Exhibit GR4 to this affidavit is this that appeared in the Jimboomba Times.
12. Sunday mail 20/1/08 RSPCA Chief Inspector, Michael Pecic, at it again raising public sympathy and donations for RSPCA at the Applicant’s expense. Page 5. Exhibit GR5 to this affidavit is this article.
13. Jimboomba Times – Poodles used as evidence. “ Michael Beatty said evidence had been put together to support a prosecution …. Found standing in inches of urine and faeces with maggot infested wounds and urine burns” “Ms Graham who had helped with the initial cleanup said their conditions were appalling” This statement is not plausible because there had been the heaviest rain in 20 years and the water would have washed any urine and all urine away. It is a clear lie. Page 6. Exhibit GR6 to this affidavit is this article – poodles to be used as evidence.

15. email: “Save the Poodles petition” is believed to have invoked much anger and justification of that anger towards the Applicant and is clearly designed to pervert the course of justice and cause the Applicant hardship in the Courts. The Applicant could not find Lawyers who would accept her instructions and her Lawyers made an attempt to have her declared mentally unfit with an adult guardian being appointed to manage her affairs. They were then going to surrender all her dogs to the RSPCA. This petition caused the Applicant harm in her cause to get her dogs back. It was RSPCA instigated as only RSPCA could foster my dogs as they were responsible for their care. This “petition” clearly states “We the undersigned call on the Law Courts of Queensland to put a stop to the abuse, cruelty and neglect of the 100+ Poodles that were seized by the RSPCA on Wednesday the 9th January 2008, by not allowing the owner – Mrs Geraldine Fooi Fong Robertson to retain ownership. We also petition that she never be allowed to own animals of any description again”. Exhibit GR8 to this affidavit is this email.
16. I have been told and verily believe there were many of these emails sent to Judges, Barristers and others all over Australia and the world.
17. The Poodle Clubs became involved seeking donations and further inflaming and enraging people against the Applicant – driven by RSPCA and RSPCA associate Sue Graham.
18. The Poodle Clubs became involved seeking $ donations from Poodle clubs Australia wide Example:- Julie Henville’s letter. RSPCA and Sue Graham enlisted others in RSPCA and her campaign against me. Page 12. Exhibit GR9 to this affidavit is this email.
19. On the 22nd February 2008 RSPCA seized personal and business records belonging to the Applicant. These records were used privately and my contacts were approached and I was defamed to them. RSPCA were seeking foster homes for my dogs. NOTE:- These records were not used in the Magistrate Appeal Hearing against Forfeiture M6213/08. That my contacts were approached and I was defamed to them is supported by the email forwarded to me from John Dougall. Sue Graham tells him “I would suggest you get your facts straight, you are being “hand fed” and have no idea of what is going on with these poor dogs, as for being jealous – I think not.” John Dougal had said he did not like the harm that was being done to me. Exhibit GR10 to this affidavit is this email.
20. RSPCA and Sue Graham were working together to cause me harm. This is verified by David Graham telling one of my many customers how Sue Graham had finally been successful after some 30 years. There was a conspiracy organised against me and this conspiracy was driven by Sue Graham’s vendetta of 30 years. Page 15. Exhibit GR11 to this affidavit is this article.
21. The defamation of the Applicant went international and reached the Applicant’s overseas customers. New Zealand TV station 3 published material provided to them by or from RSPCA. The Applicant was misquoted and never said they were a bit neglected nor that she was breeding to fund her retirement. Page 18. 22. ABC – “RSPCA rescues scores of malnourished poodles”. “RSPCA spokesman Michael Beatty says it is one of the worst cases of neglect he has ever seen and the kennel owner is likely to face animal cruelty charges. "The pens were inches high in faeces and urine the animals - all of them - had extended dreadlocks," he said. "Some of those animals were malnourished, a lot had infections of the ear, there were maggots in many cases in different wounds." Michael Beatty was present on the 9 January 2008 walking around and through my property and home with a big grin and his hands behind his back! What he said and reported in the news is totally different from what he saw. Exhibit GR13 to this affidavit is this article.
23. RSPCA had press releases to gather public support and sympathy resulting in record massive public donations of cash, dog food and houses (real properties) on the Gold Coast for the “malnourished neglected poor poodles” in RSPCA fund raising telephone telethon in January 2008 – the telephones ran hot for 24 hours. Page 20. Exhibit GR14 to this affidavit is this article.
24. Yahoo 7 Forum filled with words inciting others to punish me dated 13.1.2009. Many of these forums had RSPCA people inflaming sentiment against me. I since the identity of the people writing on these forums is anonymous I cannot know who is writing these articles. When we consider who has the self interest and has the form and has done this defaming in the past the RSPCA takes the blame. Page 21. Exhibit GR15 to this affidavit is this article.
25. RSPCA use the Otzion Forum to continue the verbal assault on me. Page 25. Exhibit GR16 to this affidavit is this forum printed.
26. “Where do puppies come from” web site continues to publish material defamatory about me. Page 30. Exhibit GR17 to this affidavit is one such article.
27. RSPCA Australia publishes in the internet material defamatory of me. Exhibit GR18 to this affidavit is this article.
28. Brisbane Times calls me “dog abuser”. And says “Neglected dogs found caked in faeces”. Exhibit GR19 to this affidavit is this article.
29. Cat Rescue an RSPCA subsidiary, affiliate or owned web site published more defamation based on malicious and fictions lies. There is no such thing as a Breeders license. Page 42. Exhibit GR20 to this affidavit is this article.
30. Geraldine Robertson defamation was translated to Chinese and published in Asian newspapers where many of her customers were. Translated. Page 48. Exhibit GR21 to this affidavit is this article.
31. 32. Courier Mail – “Caring costs hit RSPCA”. They are blaming me for their costs when if they acted properly they would not have taken my dogs in the first place. Page 61. Exhibit GR23 to this affidavit is this article.
33. Dogzonline Internet Forum was used extensively by RSPCA to defame the Applicant. Others joined in resulting in incitement to violence and worse. Exhibit GR24 to this affidavit is this article.

HORRIFIC cases of neglect and animal cruelty are stretching RSPCA
resources to breaking point.
A record number of complaints has swamped the association so far this
year, with RSPCA officers called to investigate more than 40 cases a
day.
In one of the most appalling incidents, more than 100 dogs were
seized from a boarding and breeding kennel last week after being
found in squalid conditions.
RSPCA inspectors and police raided Waterford Boarding Kennels and
Cattery, just south of Brisbane, on Wednesday.
Dogs on the property – including pure-bred poodles, labrador pups and
a pomeranian – had not been groomed for some time and were in filthy
enclosures.
RSPCA veterinarian Anne Covill said the living conditions
were "abysmal", with many dogs suffering skin inflammations and
riddled with worms.
"Internal parasites are another issue but it is too early to tell how
bad it will be," Dr Covill said. "It's the worst condition I have
seen in such large numbers."
RSPCA spokesman Michael Beatty said inspectors had received 441
complaints of animal cruelty or breach of duty of care since January
1 in Queensland.
Mr Beatty said the number of calls to the Queensland RSPCA call
centre had risen dramatically, due in part to the popularity of
television show RSPCA Animal Rescue.
"Before the show aired we were receiving between 9000 and 11,000
calls per month to our call centre," Mr Beattie said. "Since the show
aired, our call centre has received about 20,000 calls per month.
"We just wish we had the staff to keep up."
The 101 dogs seized from the Waterford property included six being
boarded there by their owners, who were being contacted by the RSPCA.
Eight of the dogs had been bought and were to be sent overseas.
Pure-bred poodles sell for between $850 and $3000.
Geraldine Fooi Fong Robertson, 62, is registered with the Australian
Securities and Investment Commission as the owner of the "breeding
and grooming" business.
A sign at the front of the 2ha property also advertises services
including clipping and grooming.
But Beaudesert Shire Council said Mrs Robertson did not hold a valid
boarding kennel licence and had been given no environmental authority
to conduct such a business in the shire.
The Sunday Mail was present when the RSPCA and police launched their
raid armed with a warrant to enter the property.
Mrs Robertson initially refused to allow the inspectors into her
house and yelled that negligence claims were "vexatious" and "false".
She relented after being warned her door was about to be kicked down
and she could be arrested for failing to comply with the warrant.
Mrs Robertson, who maintained the dogs were well-fed and seen to
regularly by a veterinarian, admitted looking after the dogs was hard
work on her own.
"I agree it's too much for me," Mrs Robertson allegedly said to
inspectors.
RSPCA veterinarians vaccinated and groomed the dogs and will now
monitor the animals for any signs of the canine parvovirus.
Inspectors are considering charging Mrs Robertson with breach of duty
of care, which carries a maximum $22,500 fine or 12 months'
imprisonment.
In 2007, 15 boarding kennels, 332 pet shops, 22 tourist attractions
and eight circuses were investigated following complaints made by the
public.
NOTE: The above had not been to court and was not proven. “The Horrific cases of neglect had no substance in law and could not be properly said”. That it was said has caused the Applicant great harm and became trial by media and internet forums.
Silvaro: This one has been known by many breeders as doing the wrong thing for a long time. There are alot of things I could go into but this could lead to trouble of what alot of breeders do know about her. Even complaints have been made on petlink when she sold a breeding pair, the guy paid $3,500.00 for the pair and didnt even see the goods. I could believe this and many other things.

101 dogs found in 'appalling' conditions
THE RSPCA says they are investigating laying charges against a woman whose kennel in Brisbane's south was discovered containing 101 dogs in "appalling" conditions.
RSPCA spokesman Michael Beatty said the dogs, mostly poodles, were today being nursed back to health following a raid on the kennel, at Waterford, in Brisbane's south, on Wednesday.
Mr Beatty said the woman had been a breeder whose kennel licence had lapsed.
He said conditions at the kennel were "appalling''.
"Virtually all of them had fur that hadn't been clipped in God know's how long and mattered, clotted with urine and faeces,'' he said.
"They had ear infections, they had maggots in places where you really don't want maggots.''
He said investigations were continuing and the woman could face charges under animal care and protection legislation.
Poodlemum: Totally disgusting - turns my stomach to think of Poodles (or any dog) being abused like that to make money. I hope they lock her up & throw away the key - but she'll probably just get a slap on the wrist.

It is no wonder registered breeders get a bad wrap when one of its own does something like this. I can only speak from my experience and I am certainly not labelling all who work for them or volunteer - as volunteers and workers you are helping those that happen to be 'lucky' enough to make it there BUT when complaints come in by the book full and you have an inspector sitting on their fat arse drinking coffee and chatting its no wonder complaints arent acted on, not saying this case. Why cant RSPCA hold over their court dates until a judge who does dish out 'suitable' punishment is on the bench, hell solicitors do it all the time for their clients to have the best possible outcome. We seem to follow the US in a lot of areas why be different here they dish out severe penalties etc for animal crulety over there dont they, come on justice system and RSPCA get some gumption and guts about you and dish it out. A long time ago when I didnt know her, I rang and she said $1,800.00 so why would she drop the price when they can afford to pay overseas. Im glad I listened to my instincts back then, she rang 3 times after that, she was so persistent to try and sell. I wouldnt wear it though.

puredogz: Just having a moment to try and stop shaking after watching this evening news. Yes I saw photos this morning but watching it live is something else. I feel sick in the stomach. I am glad that finally Geraldine has been made as public as this. No animal should live in this condition for the sake of making money. Yes they are alive but they are certainly not living! I hope that the dogs will recover and find lovely new homes where they are treated like a Poodle should.

The RSPCA does not like rehoming puppy farm dogs because of the behavioural issues associated with lack of socialization, terror of people, from living in cages.
As we know it can take months for a dog with that level of negligence and misery in it's life to be rehabilitated.
I only hope some have a future.

freundhund: Whether the RSPCA manages to prosecute this "woman" or not. The media for once had done something and that is they released her name!!!!!!!! Not normally done for legal reasons.
So for once I personally cannot complain about trial by media. I have looked at a lot of footage, with the state the dogs are in, I believe the RSPCA will bring action. The media has a good chance of forcing this. If not there is a good chance that the DPA will do a deal with this woman something a long the lines of she surrenders all but 1 or 2 dogs to the RSPCA, they might even inclued a no breeding clause. To be honest as long as this person doesn't get her dogs back does it really matter!!!!!!!!!!!

RSPCA really ought to get their act together. Its not just ppl dobbing asshole breeders like this in but the puppy farms that were reported one raid was done and they say they were ok, even though the dogs were in the same and worse condition, tick riddled, flea riddled, shit all over the place. At the end of the day people will be judged for their actions, its probably a good thing I wont be in charge though :-) Some people just dont give a toss, if she isnt charged/sent to jail maybe they should make her to community service with a animal welfare orgainsation and see other peoples dogs and cats in that condition and see if she 'feels anything at all' and let her help with the pts the whole time she is there and see how she copes then! terry f As this woman was in the dog breeding business solely for the money, not a collector, or any obvious mental problems, I was wondering what an appropiate punishment would be. The punishment IMO should be enough to deter her to ever do this again and also to discourage others.
I believe she should at the very least be made pay for all costs from boarding, feeding, vet bills and anything else these poor dogs might require to enable them to be rehomed. Whatever we think of the RSPCA, I don't think they should have to pay the costs of bringing these dogs back to health.
I would hate to think that these dogs could be sold at a later date and this woman would profit from the good intentions of people and charities. Unfortunatley, anything is possible

Until a case like this goes before a magistrate who finds against an owner, the legal ownership of the seized dogs, is in limbo.
Which is why the dogs can't be adopted out in the interim by RSPCA Qld. And it's why there can be a long wait (months)....because it all depends on court schedules for the case to get before a magistrate.
Then there's always the possibility that some legal technicality can see the RSPCA ordered to return the dogs to the owner.
That shouldn't happen too often in such an obvious case.
But it has happened in one past case, where the RSPCA Qld was ordered to return a large number of small dogs that had come from a puppy farmer, in equally appalling condition. Yes....due to some legal technicality, nothing to do with the worth of the case.
Fortunately, the RSPCA managed to reach an out-of-court settlement with the 'farmer' for the dogs to be signed over to them.
This is why all those associated with seizing dogs from awful, awful circumstances.....walk on egg-shells & hold their breath....until the findings of the court process. Just one legal technicality can unravel the whole thing.
I also agree with you that in extreme cases of obvious neglect & suffering by dogs, the owners should face bans on future dog ownership. ( I believe this should be the case whatever was the condition or motivation of the owner. )
There is provision in Qld law for animal ownership bans to be placed on people, by the courts. Can be for a certain period or can be for life (tho' the person can appeal). I think there's already been at least one high profile case (hoarding) where it has been applied.
Lionheart, I agree with you, too, that lack of socialisation for dogs kept like this, can be as injurious as the physical neglect. The chief inspector of RSPCA Qld wrote an article on the awful results of puppy farming (in 2001) & stressed this point that puppies' & dogs' need socialisation as much as physical care.

I knew of one experienced foster-carer who had a little tibbie rescued from an horrific puppy-farm. Pretty little mainly white creature. She had orange legs nearly up to her armpits.
Didn't matter how many times she bathed her, the orange stayed there. So the carer was taken by this unusual colouring.
It turned out, the 'orange' was from this little dog spending her life up to her armpits in urine & faeces. It had 'dyed' her white legs. Eventually over time, the 'orange' faded.
terry f If they are in a foster carers programme, would those same foster carers be able to write a report on the physical and mental condition on the dogs. Photographic evidence on the dogs improvement might also influence the court that these poor dogs could never go back to the original owner.
What a nightmare for a dedicated FC to nurse one of these dogs back to health, only to have some legal technicality to allow the return of these dogs to that woman.
I bet none of them have names, just breeding machines.
I would imagine that for its own protection the RSPCA would have to have written individual reports on all 101 dogs. If individual reports from FCs and the RSPCA were submitted to a court, together with photographic evidence the case would be very strong against this female.The only good thing about this situation , is that the dogs are purebred poodles. IMO they will rehome very quickly, but maybe some or most of these dogs may be so stressed they might have to be sent to the bridge. I have read reports from private rescue organisations who have saved dogs from puppy farms and they all wrote it does take a long time to rehabilate these dogs and even after all that time they can only be rehomed to specific people.
I wonder what defence this woman is thinking of. Afterall these dogs represent an income to her. I would not be surprised to find out she has a financial backer behind her.
Wirh regard to the six dogs that were to be exported overseas, does anybody know what country or countries they were destined for. There must be some international marketing going on somewhere or maybe it just a website. Just curious.

I understand that the dogs for overseas went to Singapore and that ones already bought and paid for had to be sent - there was nothing anyone could do about that. It is quite beyond my understanding how anyone can behave like this.

That was done, I was hit with a bottle by a stranger in front of my home. I also received threats with regards to injure me and to kill me “like she did to her dogs” which in fact never occurred as I love all my poodles passionately having owned poodles and no other breed for over 48 years.
38. I have a witness who saw the numerous threatening letters and was at my premises when I received death threats. When we say continuous, there were continuous telephone calls 24 hours from the 13th January 2008 onwards. I telephoned Telstra to record the calls but it was impossible according to Telstra who advised me to put my telephone on answer service which I did. The Police were called on 000 when I was assaulted with a bottle and numerous telephone calls were made to the Police about the telephone threats, I was really terrified that they will return to beat me as they had threatened..
